ARTICLE I
ORGANIZATION
SECTION 1 - NAME
This organization shall be known as the Associated Fire Fighters of Illinois and shall be affiliated with the International Association of Fire Fighters.
SECTION 2 - OBJECTIVE
The objective of this Association shall be to cultivate a closer feeling of friendship and fellowship among the Fire Fighters of the State of Illinois, and the promotion of legislation to advance the welfare of the Fire Fighters. This Association shall also have for its objective the furthering of efficient and adequate fire protection for the taxpayers and citizens of Illinois; the rendering of assistance on any Local Union, and will cooperate with the International in rendering assistance to the Locals.
SECTION 3 - GOVERNMENT
This State Association shall recognize, observe, and be bound by provisions of the International Constitution and By-Laws and interpretations thereof rendered by the International General President, decisions and directives of the Executive Board of Officers of the International Association of Fire Fighters, and the resolutions adopted and policies established by the delegates at International Conventions. This Constitution and By-Laws shall be supplementary to the International?s Constitution and By-Laws and establishes hereby procedures for the conduct of this organization subject to the governing features of all applicable provisions of the International Constitution and By-Laws particularly governing State Associations as set forth in Article XIV. None of the provisions of this organization?s Constitution and By-Laws shall be in conflict with any of the provisions of the International Constitution and By-Laws.
The delegates assembled at the Associated Fire Fighters of Illinois Conventions shall be the supreme authority of this Association and shall constitute its highest legislative, executive and judicial body. All decisions and actions of the delegates at Convention shall be binding upon all officers, members and subordinate bodies of this Association. They shall have the sole authority to make, amend, revise or modify the laws for the government of this Association, except as that authority may be delegated at Convention to the officers or Executive Board, or except as such laws may be superseded by applicable law.
Between Conventions of the Associated Fire Fighters of Illinois, all administrative, executive and judicial powers of the Association shall be vested in the Executive Board, except as otherwise expressly provided in this Constitution and By-Laws.
It is the obligation and responsibility of every officer and member of all affiliated Locals to comply with the provisions of this Constitution and By-Laws and the decision of the Association?s officers in conformity therewith, and they shall refrain from any conduct which interferes with the performance by the Association of their obligations under law or contract, or any conduct which defeats or subverts the lawfully established and declared policies and objectives of the Association, or which may defame it or any of its officers or members.
The influence or sympathy of the Association as an organization shall not be enlisted or used in favor of any religious sect. No member of the Association shall discuss any religious matters at meetings of the Association or criticize the religious beliefs of any member.
All correspondence directed to the Associated Fire Fighters of Illinois, including but not limited to official union business, shall be directed to the AFFI Office in Springfield, Illinois, where it shall be date-stamped and directed to the appropriate party.
All correspondence relating to the Biennial Conventions shall be directed to the AFFI Office in Springfield, Illinois, where it shall be date-stamped and directed to the appropriate party.
All official Convention documents including, but not limited to, Credentials and Resolutions shall be directed to the AFFI Office in Springfield, Illinois. These documents shall be formally acknowledged on the day they are received with a date-stamp and copied, with copies distributed to the Secretary-Treasurer and the President. All originals of official Convention documents will remain in a secure and permanent location at the AFFI Office until such time as they are required at the Convention site. Following the Convention, these documents will be stored in a secure and permanent location in the AFFI Office.
SECTION 4 - ORGANIZATION IS NON-PARTISAN
This organization shall be non-partisan and shall not be used for the dissemination of partisan principles, but shall be used for dissemination of information about those candidates for political office who have expressed themselves or declared themselves favorable or have demonstrated their support by their voting record. Information disseminated pursuant to this article shall be solely devoted to furthering the best interests of the Fire Fighters of the State of Illinois.
ARTICLE II
MEMBERSHIP
SECTION 1 - JURISDICTION
The membership of the organization shall be composed of such Local Unions in the State of Illinois as are chartered and affiliated, and in good standing with the International Association of Fire Fighters.
In addition to its membership of affiliated Local Unions within the State of Illinois, this organization may admit to membership only individuals from cities and towns where no Local exists, provided that such applicants otherwise meet the qualifications for membership in the International Association of Fire Fighters. The International General Secretary-Treasurer shall issue regular membership cards to all such individuals submitted to membership marked ?State and City? where such members are employed. This organization shall establish and collect sufficient initiation fees and dues from each individual admitted to membership to permit payment to the International of its established proportion of such fees and per capita tax on such members as provided in Article VIII of the International?s Constitution, and the Secretary-Treasurer of this organization shall remit the same by check or money order to the International General Secretary-Treasurer as in the case of Local Unions. All such members shall be subject to the same requirements with respect to payment of dues, maintenance of good standing, and issuance of dues cards as provided for Local Unions.
Members of this Association shall not work as EMT?s Paramedics or Fire Fighters for any private company with a contract to provide such services with any public service employer. Members are prohibited from being part-time, paid-on-call, volunteer or otherwise be employed by any Fire Department, Fire Protection District, Fire Company, or Ambulance Service that employs Fire Fighters, EMT?s and/or Paramedics unless otherwise approved by the affected Locals having jurisdiction, or in order to provide temporary service as part of a locals program to prevent the contracting out of such service to a private contractor. Members found in violation shall be subject to the provisions set forth in Article XVI of the Constitution & By-Laws of the International Association of Fire Fighters but not limited thereto.
SECTION 2 ? ASSOCIATE MEMBERSHIP
Associate membership shall be available to IAFF Locals currently unable to participate due to federal law conflicts who wish to participate in the educational, fraternal and political activities of the AFFI. Associate membership shall have no voting rights within the Association.
ARTICLE III
OFFICERS
SECTION 1 - NUMBERS AND TITLES
The officers of this Association shall consist of a President, Secretary-Treasurer, six (6) Vice Presidents, three (3) Legislative Representatives and three (3) Trustees.
SECTION 2 - TERMS OF OFFICE
Such officers shall be elected by the duly accredited delegates at Convention, and a majority vote on written ballot shall be necessary to elect if it is a contested election. They shall hold office for their term, or until their successors are elected and qualified. Their term of office for this organization shall be four (4) years, and the terms of President, District Four, District Five and District Two Vice Presidents, Northern District Legislative Committee Member and Central and Southern District Trustees are to be staggered as not to be concurrent with the terms of the Secretary-Treasurer, Vice President-At-Large, District One Vice President, District Three Vice President, Central and Southern District Legislative Committee Members and Northern District Trustee. A duly elected officer shall forfeit his office when his Local Membership is terminated.
SECTION 3 - METHOD OF NOMINATION AND ELECTION
1. The President of the Association shall announce as a special order of business the date and time of election of officers.
2. Nominations for office shall be a special order of business to be conducted in the afternoon before close of business on the first day of Convention and no elective officer shall be entitled to hold more than one office at the same time, nor shall any candidate?s name appear more than once on any ballot for elective office.
3. All candidates for office shall be regular or alternate delegates and shall be present at nomination and election except under extenuating circumstances which shall be reviewed by the Election Committee. The Election Committee shall make a recommendation to the members assembled at the Convention and such recommendation to accept/or not accept the extenuating circumstance. If the committee recommends to allow an exception, it will take a 2/3 vote to reject the committee recommendation. If the committee recommends not to allow an exception, it shall take a simple majority to over rule the committee recommendation. Write-in candidates shall not be allowed.
4. All candidates shall have been a member in good standing in their respective Local for at least one (1) year prior to nomination, and in the case of district offices, shall be a delegate or alternate delegate from the district for which office they are nominated.
5. All contested elections shall be conducted by Australian ballot. Any nominee for office, who, at the close of nominations, has no opposition may, with unanimous consent and before the ballots are printed, be declared the winner by acclamation.
6. Each candidate may have one (1) observer of his choice present at both election and counting of the ballots.
7. The Secretary-Treasurer will provide the Election Committee with a list of the number of Delegates each Local has that will be allowed to vote.
8. Six (6) tellers shall be appointed by the Chair after nominations, none of which shall be from any Local having a candidate. These six (6) tellers will comprise the Election Committee and shall be charged with:
a) the responsibility of establishing rules governing the election, to be adopted by the Convention;
b) sealing and manning the ballot boxes;
c) conducting the election between 0700 and 0900 of the 3rd day of the Convention, and;
d) tabulating the vote. They are prohibited to wear campaign material while performing their duties as election tellers.
9. Results of the election shall be announced as soon as possible after the election, but before adjournment of the Convention.
SECTION 4 - VOTING RIGHTS OF OFFICERS
All duly accredited officers shall have the right to vote on all questions, including the nomination and election of officers, that come upon the floor of the Convention while in session. Associate members will have no voting rights.
The AFFI Executive Board, AFFI Trustees, and AFFI Emeritus Officers are considered Delegates At-Large. Delegates At-Large shall be allowed to vote in elections for the AFFI offices of President; Vice-President At-Large; and Secretary-Treasurer.
Delegates At-Large shall also be eligible to vote in applicable district elections. For the purposes of determining district voting eligibility, At-Large officers shall be considered to be a member of the district where they currently retain local membership.
SECTION 5 - EXECUTIVE BOARD
The Executive Board shall consist of the President, the Secretary-Treasurer, the six (6) Vice Presidents and the (3) Legislative Representatives.
SECTION 6 - FILLING OF VACANCIES
Should a vacancy occur in the office of the President, the Vice President-At-Large will serve as acting President until the next Convention, at which time the vacancy shall be filled by Convention election. Should a vacancy occur in the office of the Secretary-Treasurer or Vice President-At-Large, the President or acting President shall notify the Executive Board, and they shall submit names from among the members of the Association to the President or acting President, and he shall select three names from those submitted. The one receiving the majority vote of the Executive Board shall be elected to fill the vacancy until the next regular Convention, at which time the vacancy shall be filled by Convention election. Should a vacancy occur in the office of District Vice President, Legislative Representative or Trustee, the President shall call a caucus of the District in which the vacancy exists, within sixty (60) days after being informed of such vacancy; said caucus shall be conducted by the President, Secretary-Treasurer and Vice President-At-Large. The Secretary-Treasurer shall notify all affiliates in that District of the vacancy and of the caucus to fill the vacancy, at least thirty (30) days prior to the convening of the caucus. All affiliated Locals will be entitled to delegate representation at the caucus as designated in Article IV, Section 2 of this Constitution and By-Laws. The caucus is to be governed by the other provisions of this Constitution and By-Laws as designated for Conventions, except that the caucus is to be for the sole purpose of filling the vacancy in office from that District. Said vacancy is to be filled on an acting basis until the next regular biennial Convention, at which time the office is to be filled by Convention action for the remainder of the term. No caucus will be called, and a vacancy in District offices will not be filled when vacancy occurs within three (3) months of a scheduled regular biennial Convention of the Association. Not more than sixty (60) days shall elapse in the filling of any vacancy.
SECTION 7 - AUTOMATIC RELINQUISHMENT OF OFFICE
Any officer of the AFFI shall immediately resign from office if promoted or appointed to the Chief of the Department or the Fire Protection District. Any AFFI Officer who is elected to an Executive Board office of the IAFF shall immediately resign his office in the AFFI.
When any officer of the AFFI belongs to a Local Union that loses membership in the AFFI either due to voluntary withdrawal, forfeiture or revocation, the officer shall be removed from office.
Any officer whose Local Union is suspended from membership shall be removed from office; however, if the officers? Local Union is reinstated within the sixty (60) days allowed in Section 6 - Filling of Vacancies, the officer shall be reinstated.
Whenever an officer of the AFFI is nominated and accepts the nomination as a candidate for another office other than the office held, he/she shall announce the resignation of the current office to be effective on the last day of convention.
SECTION 8 - EMERITUS OFFICERS, CRITERIA AND COMPENSATION
1. In order to be considered for an Emeritus status at the AFFI Conventions, the Officer must have served as an AFFI Officer for no less than ten (10) years;
2. It will take 2/3 vote to pass;
3. On travel days to and from the Convention, which are not scheduled Convention days, Emeritus compensation shall be as follows:
A. IRS allowable meal allowance;
B. IRS mileage expense according to AFFI policy;
C. Hotel accommodations on the day prior to the AFFI Convention.
4. On the three (3) days on which the Convention is regularly scheduled, the Emeritus Officer shall be assigned work by the AFFI President. If the Emeritus Officer accepts the assignment, he shall be compensated the AFFI daily meeting allowance for those days for which the Convention is convened. If the Emeritus officer chooses not to accept the assignment, he shall be compensated as per Section 3 above.
Any nomination for Emeritus status for a person not seated as a delegate shall be one of the first Resolution(s) acted upon at the Biennial Convention and the Emeritus-elect who is not already seated as a delegate shall be seated on the Convention floor, immediately upon election, as a Delegate-At-Large.
When an Emeritus Officer passes away, their name shall be moved to the By-Laws Appendix at the next printing of the By-Laws booklet.
SECTION 9 ? PRESIDENT EMERITUS
The position of President Emeritus is hereby established. This position, effective June 15, 2006 will be occupied by David B. Foreman and, effective June 14, 2008, by Michael ?Rick? Merrill, who served as Presidents of this Association. This position shall carry with it ex officio lifetime membership in the Associated Fire Fighters of Illinois and automatic selection as Delegate-At-Large to each of its Conventions. This position shall also carry with it the duty on the part of the President Emeritus to advise and consult with the Association President and/or the Executive Board upon request when such service is desired in the best interests of this Association.
SECTION 10 - SECRETARY-TREASURER EMERITUS
The position of Secretary-Treasurer Emeritus is hereby established. This position, effective May 3, 1986, will be occupied by Kenneth Dugan, effective June 15, 2006 this position will be occupied by Michael Tonne and Ronald Vinyard who has served as the Secretary-Treasurer?s of this Association. This position shall carry with it ex officio lifetime membership in the Associated Fire Fighters of Illinois and automatic selection as Delegate-At-Large to each of its Conventions. This position shall also carry with it the duty on the part of the Secretary-Treasurer Emeritus to advise and consult with the Association President and/or the Executive Board upon request when such service is desired in the best interests of this Association.
SECTION 11. LEGISLATIVE REPRESENTATIVE EMERITUS
The position of Legislative Representative Emeritus is hereby established for Mike Brennan effective May 1, 1998 and Bruce Billman effective June 15, 2006 in appreciation for their many years of dedicated service to the Association. This position shall carry with it ex-officio lifetime membership in the AFFI and automatic selection as Delegate-At-Large to each of its Conventions. The Legislative Representative Emeritus shall also have the responsibility and duty to advise and consult with the current President, Legislative Committee, and the Executive Board when requested to do so in the best interest of the Association.
SECTION 12. TRUSTEE EMERITUS
The position of Trustee Emeritus is hereby established, effective May 1, 2000 for, William McGrane (Northern District), effective June 15, 2006, for James Zindel (At-Large / Southern District), and Donald Damewood (At-Large / Central District) , and effective June 14, 2008 for Ernie Brown (Southern District), in appreciation for their many years of dedicated service to the Association.
This position shall carry with it ex-officio lifetime membership in the AFFI and automatic selection as Delegate-At-Large to each of its Conventions. The Trustee Emeritus shall also have the responsibility and duty to advise and consult with the current President and the Executive Board when requested to do so in the best interest of the Association.
SECTION 13. VICE PRESIDENT EMERITUS
The position of Central District Vice President Emeritus is hereby established for Joseph Garrison effective May 1, 2000, in appreciation of his many years of dedicated service to the Associated Fire Fighters of Illinois. This position shall carry with it ex-officio lifetime membership in the AFFI and automatic selection as Delegate-At-Large to each of its conventions. The Central District Vice President Emeritus shall also have the responsibility and duty to advise and consult with the current President and the Executive Board when requested to do so in the best interest of the Association.
The position of Southern District Vice President Emeritus is hereby established for Ronald McDonald effective June 20, 2004, in appreciation of his many years of dedicated service to the Associated Fire Fighters of Illinois. This position shall carry with it ex-officio lifetime membership in the AFFI and automatic selection as Delegate-At-Large to each of its conventions. The Southern District Vice President Emeritus shall also have the responsibility and duty to advise and consult with the current President and the Executive Board when requested to do so in the best interest of the Association.
ARTICLE IV
CONVENTIONS
SECTION 1 - TIME AND PLACE FOR CONVENTIONS
The Conventions of the AFFI shall assemble biennially in the even years in the City selected during the previous Convention, or in the case of an emergency, in a City selected by the Executive Board. The AFFI Conventions shall be held no later than June 30th as determined by the Executive Board.
No later than nine (9) months prior to convention a local wishing to host a subsequent convention shall:
1. Notify the AFFI Executive Board of its intent to bid to host the Biennial Convention.
2. Bring to the Board a proposed convention site that conforms to all criteria established in the AFFI Executive Board Policy Manual.
3. Be prepared to visit the proposed site with the Convention Review Committee.
No later than six (6) months prior to the convening of the convention where selection is made, the Convention Review Committee shall notify the requesting local(s) if their proposed site meets or does not meet the criteria established in the AFFI Executive Board Policy Manual. Should a site be rejected by the Convention Review Committee, that local may submit an alternative proposed convention site for approval. Any site approval must be completed thirty (30) days prior to the convening of the convention and all approved host Local sites shall be placed on a ballot, unless withdrawn, and subject to convention selection by majority vote. Once the approved site is selected, negotiations with the Convention Hotel shall be conducted solely by the AFFI and the contract is to be signed by the AFFI President.
The host Local of the AFFI Biennial Convention shall keep accurate records including, but not limited to, number of hotel rooms taken (per day), number of delegates, alternates, and guests registered, number of persons attending reception, the number of hospitality rooms taken, the price charged for rental of hospitality rooms, a breakdown of the amount of alcohol sold to hospitality rooms, the price charged for hospitality room alcohol and supplies, an itemized list of any articles of Convention clothing sold, the number of participants in any event(s). The Host Local shall compile this information and submit it to the Secretary/Treasurer of the AFFI and the President of the Local scheduled to host the next Convention no later than six (6) months from the close of the Convention that they hosted.
SECTION 2 - CONVENTION DELEGATES
Representation in Convention shall be as follows: Locals with a membership of 25 or less shall be entitled to one (1) delegate; 26 to 50, two (2) delegates; 51 to 75, three (3) delegates; 76 to 100, four (4) delegates; 101 to 150, five (5) delegates; 151 to 200, six (6) delegates; 201 to 250, seven (7) delegates; 251 to 300, eight (8) delegates; 301 to 350, nine (9) delegates; 351 to 400, ten (10) delegates; 401 to 450, eleven (11) delegates; 451 and over, twelve (12) delegates; and the Officers of the Association shall be Delegates-At-Large by virtue of their office.
Representation of Local Unions will be allocated on the basis of the average number of active members on which per capita is paid monthly by the Local Union and one-half the average number of retired members on which per capita is paid monthly by the Local Union (rounding up to the next whole number, not including agency shop employees) during the preceding twelve (12) months prior to the processing and mailing of the credentials. In the case of new Local Unions not affiliated for the full preceding year, per capita tax will be averaged over the period of their existence on a monthly basis.
Any Local to be entitled to representation at Convention or in an initiative referendum must have their per capita tax paid on its full membership up to one (1) month previous to the date of the convening of the Convention. Delegate strength will be determined 90 days prior to the scheduled convening of the Convention.
SECTION 2.1 - ILLINOIS ASSOCIATION OF RETIRED FIRE FIGHTERS
The I.A.R.F. shall be entitled to three (3) Delegates at the AFFI Conventions. These Delegates shall have the same rights as other Delegates, except for the right to hold office. These Delegates shall have the right to vote for statewide AFFI Officers.
SECTION 3 - VOTING RIGHTS AT CONVENTION
Each Officer or Delegate shall be entitled to one vote only. No Member of the Association, other than a duly accredited Officer or Delegate, shall be entitled to a vote in Convention. Officers and Delegates must be present to cast their vote.
SECTION 4 - ALTERNATE DELEGATES
Locals are only entitled to send Alternate Delegates in an equal amount to the number of Delegates they send. Alternate Delegates may be seated upon presentation of proper credentials. Alternates may vote in the absence of regular Delegate. A Delegate may only be replaced by a Registered Alternate.
SECTION 5 - CREDENTIALS
Credentials for Delegates, as provided for in Article IV Section 2, shall be sent to affiliates by the Secretary-Treasurer. Credentials for Alternate Delegates may be requested by an Officer of affiliated Locals, as provided for in Article IV Section 4. Credentials must be signed by two (2) Officers of the Local and have the Seal of the Local affixed. They shall be submitted to the AFFI Secretary/Treasurer at least thirty (30) days prior to the convening of the Convention in order to be assigned to a convention committee. Convention committee requests, in order of priority desired, shall be submitted with credentials at least thirty (30) days prior to the convening of the convention. Credentials received after twelve (12) days prior to the convening of the convention shall require a 2/3rds (two-thirds) vote of the convention delegates in order to be seated.
SECTION 6 - RESOLUTIONS
Convention Resolutions may be submitted by the AFFI Executive Board, any AFFI Executive Board Officer, any AFFI Emeritus Officer, the Board of Trustees, any standing Committee established by Convention action or any affiliated local. Any resolutions are to be submitted to the AFFI Secretary/Treasurer at least thirty (30) days prior to the convening of the Convention. Resolutions submitted after this date will require 2/3 vote of the Convention Delegates to be received.
All Resolutions which, in the determination of the Secretary-Treasurer, have an economic impact on the Association, such impact will be determined by the Secretary-Treasurer, subject to review by the Executive Board, and attached to said Resolution before Committee assignment. Adoption of Resolutions having economic impact will increase the per capita tax sufficiently to cover the cost of the impact. Cost factors cannot be amended out of such Resolutions.
SECTION 7 - CONVENTION GUESTS
Members of the Associated Fire Fighters of Illinois in good standing may be seated as a guest upon the request of their Local?s Delegate. Other visitors may be seated by permission of the Convention.
SECTION 8 - SERGEANT-AT-ARMS
The President shall appoint a Master Sergeant-At-Arms for the security of the Convention room and additional Sergeants-At-Arms as necessary. The appointment shall be made sufficiently enough prior to the Convention so he/she will be able to inspect the site and set up security measures so as to be able to control admission to the hall.
SECTION 9 - REGISTRATION DEADLINE
Delegates and Alternates to the Associated Fire Fighters of Illinois Convention must be
registered and seated by 1700 of the first business day of the Convention. Quorum and Legal Majority, for purposes of this Article shall be ten (10) per cent of the eligible locals that are present or participating. A majority of delegates present and voting shall legalize action on all questions except as may otherwise be expressly provided in this Constitution and By-Laws.
SECTION 10 - REGISTRATION FEE
A Convention registration fee of $75.00 for each Delegate and Alternate, and $35.00 for each adult guest must be paid at least thirty (30) days prior to convention. A convention registration fee of $100.00 for each Delegate and each Alternate and a $50.00 fee for each guest shall be charged anytime after thirty (30) days prior to convention. This fee shall be used by the host local to defray costs and to host a Convention Reception to be held on the first or second night. Registration fees shall be paid to the Host Local before Delegate and Alternate are issued their Convention badges.
No refunds shall be given.
SECTION 11 - DRAM SHOP INSURANCE
The Convention Host Local shall be required to provide dram shop insurance to cover all
hospitality rooms at all AFFI Biennial Conventions, provided that the host site does not provide such insurance.
SECTION 12 - EMERGENCY CONVENTIONS
The Executive Board shall have the authority to call an emergency convention at any
time an emergency arises requiring such action, provided that forty-five (45) days notice shall be given to all Local Unions of the AFFI to permit election and accrediting of Delegates.
ARTICLE V
REVENUE AND FUNDS
SECTION 1 - FISCAL YEAR
The fiscal year of the Association shall begin on the first day of January and end on the last day of December of each year.
SECTION 2 - PER CAPITA TAX
Effective July 1, 2008, the per capita tax shall be $12.51 (twelve dollars and fifty one cents) for active members and $6.27 (six dollars and twenty seven cents) for retiree-pensioner members who retain active membership. Locals paying on a membership of 500 shall pay a per capita of $11.48 (eleven dollars and forty eight cents).
Per capita shall increase annually on May 1st by an amount equal to the Consumer Price Index for the Midwest Urban Region as published by the U.S. Department of Labor for the preceding year ending December 31st to cover inflationary cost increases for all per capita items except salaries and meeting allowances. The increase shall not exceed five percent (5%) annually and shall be reviewed at each biennial Convention.
Per capita tax shall be paid on each member by each affiliated Local with less than 500 members; however, no Local shall pay per capita tax on more than 500 members.
The Associated Fire Fighters of Illinois fully supports our troops and the AFFI will waive collection of all State Association per capita for any members called to active duty status for the entire time that a member is serving without loss of benefits that are afforded members of our union by the State Association.
SECTION 3 - SPECIAL ASSESSMENTS
Special assessments shall be levied by referendum vote by secret ballot whenever it becomes necessary to carry out organization or legislative work by a majority of the entire membership or at Convention assembled. The Secretary-Treasurer shall send out ballots to all Locals according to the Membership paid thereon. The ballot shall be returned to the Secretary-Treasurer with the seal attached attesting the results thereof.
SECTION 4 - LEGAL ASSISTANCE FUND
The Secretary-Treasurer shall establish and maintain a Legal Assistance Fund which will
be used, subject to procedures established by the President and Executive Board, to financially assist in the resolution of legal disputes in which affiliates of this Association may become involved. Effective July 1, 2008 the legal assistance fund will be funded with ten percent (10%) of all fundraising revenues plus 20 cents per capita tax.
The annual CPI increase collected on these funds shall be directed to the legal assistance fund.
SECTION 5 - POLITICAL ACTION FUND
Not less than four dollars ($4.00) per member per month effective May 1, 2001 for each affiliated Local, should be collected and deposited in the Political Action Fund to be used in the best interest of the Association by the Political Action Committee. No Local shall pay on more than five hundred (500) members. Local Secretary-Treasurers shall collect said funds and forward them to the Treasurer of the Political Action Committee who will deposit them into the Political Action Account.
SECTION 6 - ILLINOIS ASSOCIATION OF RETIRED FIRE FIGHTERS
They shall pay per capita tax on a maximum of two hundred and fifty (250) Members at the rate of one-half (½) of the active Member rate.
SECTION 7 ? ASSOCIATE MEMBERSHIP PER CAPITA
Associate membership shall be at half the per capita cost of full membership.
ARTICLE VI
FORFEITURES AND REVOCATIONS
OF AFFILIATION
SECTION 1 - NOT REPORTING ON NEW MEMBERS
Any Local with less than five hundred (500) members accepting new members into its organization and not reporting same to the State Association and not paying per capita tax on same shall be deemed violating the membership agreement of the Association and shall be subject to suspension from the Association.
SECTION 2 - NON-PAYMENT OF PER CAPITA TAX
The Secretary-Treasurer shall provide written notice to a Local Union and to the District
Vice President that the Local is delinquent in paying per capita tax after forty-five (45) days. Any Local affiliated with the Association which fails to pay its per capita tax for a period of three (3) months shall be suspended from membership after proper notification by the office of the Secretary-Treasurer.
SECTION 3 - REINSTATEMENT
The suspended Local, or a Local whose charter has been revoked as provided in Article VI, Section 4, may be reinstated in the Association upon payment of all arrearages, provided, however, that in exceptional cases, the President, with the consent of the Executive Board, shall have the power to remit such arrearages when circumstances warrant such action.
SECTION 4 - REVOCATION
The Executive Board is hereby vested with the authority to revoke the membership of any Local whenever, upon evidence satisfactory to the majority of the Executive Board, it is shown that the Local has been guilty of disloyalty or where its actions have been adverse or detrimental to the welfare of the membership of the State Association.
Any Local which affiliates with an organization that has been declared to be a rival organization by the IAFF shall automatically forfeit any right to membership in the Associated Fire Fighters of Illinois. Also, any Local which remains affiliated with a rival organization after notification that the organization has been declared to be a rival organization by the International Association of Fire Fighters shall automatically forfeit any right to membership in the Associated Fire Fighters of Illinois. Any prepaid dues or prepaid registration fees will be returned along with notice of forfeiture of membership and charter
SECTION 5 - REVOCATION REPORT AND APPEAL PROCEDURES
The Executive Board shall report in detail all of the evidence upon which it revokes the
membership of any Local, and said Local shall have the right to appeal to the Convention of the Association to have such action of the Executive Board set aside. Matters appealable according to Article XVIII of the International Constitution and By-Laws may be carried further in accordance with the provisions of that Article. Where any individual member or Officer of this Organization or its affiliates is charged with misconduct as defined in Article XV of the International Constitution, he shall be served with written specific charges as required in Article XVI of the International Constitution and be given a reasonable time to prepare his defense and afforded a hearing as provided in Article XVII of the International Constitution. Such appeal must be filed with the General President of the International Association within thirty (30) days of the action to be appealed.
ARTICLE VII
DUTIES OF THE OFFICERS
SECTION 1 - ELIGIBILITY OF OFFICE
No person shall be eligible to hold office or to membership on any Committee unless he
is a dues-paying member in good standing.
SECTION 2 - DUTIES OF THE PRESIDENT
The duties of the President shall be to preside over all meetings; he shall be empowered to appoint all Committees and be a member of all Committees, either appointed or elected, and he shall serve as an active member of the Legislative Committee; he shall be a delegate to the International Association of Fire Fighters Conventions, the Illinois State Federation of Labor-Congress of Industrial Organizations Conventions, and other such Conventions, meetings and/or conferences that this Association may be affiliated with and shall serve as Chairman of our Delegates to them. He shall submit to each Convention a report of all his official acts during the interim between Conventions. He shall be Chairman of the Executive Board. He shall be editor of all official Association publications. He shall direct staff and contractual employees through policy established by the Executive Board. He shall perform all other duties that this Association shall require of him.
SECTION 3 - DUTIES OF THE SECRETARY-TREASURER
The Secretary-Treasurer shall receive all monies due the Association from whatsoever
source, except contributions to the Political Action Fund, which are to be sent to the Treasurer of the Political Action Committee, and shall be the custodian of the official seal and all records, books, papers and property of the Association, except as may otherwise be provided in this Constitution and By-Laws. He shall also be a Delegate-At-Large to all Conventions of this Association by virtue of his office and shall have a voice and vote on all matters before such Conventions and shall also be a Delegate to the International Association of Fire Fighters Conventions, District Caucus Meetings and Federation of State and Provincial Professional Fire Fighters Meetings. He shall keep an accurate journal of all Convention proceedings and shall maintain such record. He shall also keep or cause to be kept accurate minutes of all proceedings of the Executive Board and shall maintain such minutes with other records of the Association. He shall mail to each affiliate Local a copy of minutes kept, along with a summation of all AFFI financial reports and fund balances. He shall also mail to the Affiliates updated AFFI policy booklets. This information must be provided within 30 days of Executive Board meetings, district meetings, Convention or special session. He shall publish and distribute any revisions of the Constitution and By-Laws within ninety (90) days of adjournment of the Biennial AFFI Convention.
He shall maintain and keep current a record of all members of the Association together with their Local Union. He shall furnish to the Committee on Credentials at each Convention a statement of the financial standing of each Local or other subordinate Union and the number of Delegates it is entitled to seat in the Convention. He shall also submit to each regular Convention of the Association a report of his official acts during the interim between Conventions.
He shall conduct all necessary correspondence of his office including any directives or mailings that may from time to time be requested by the Chairman of the Legislative Committee and attest all documents with his signature. He shall conduct all administrative duties of all official Association publications.
With the approval of the Executive Board, he shall employ such clerical and other assistants as may be necessary for the efficient discharge of his duties and the general administration of the Association?s business and shall pay such salaries as the Board approves. He shall also serve as Secretary of the Executive Board.
He shall have charge of all funds of the Association, except political action funds, and shall make disbursements there from by the voucher-check system to cover all expenses of operating and administering the business and affairs of the Association as authorized by this Constitution and By-Laws and any resolution adopted by the Executive Board pursuant to authority herein granted. The AFFI Secretary Treasurer shall encumber AFFI Honor Guard generated funds not spent in any fiscal year.
He shall be prepared to exhibit receipts and vouchers, upon the examination of his books, and furnish any requested information to the Board of Trustees, or any auditors employed by it or to the Executive Board. All books of the Association shall be open to inspection at any time by the Executive Board or Board of Trustees.
He shall be bonded at all times in an amount of full coverage, the cost of said bond to be paid by the Association.
He shall receive all applications for affiliation and, when accompanied by the required fee and dues and submitted in compliance with all applicable provisions of this Constitution and By-Laws, he shall endorse such application for affiliation and forward it for approval of the President.
He shall discharge on behalf of the Association such duties as may be imposed upon him by applicable law, including the execution and filing of any reports to federal and state authorities (except that such reports relative to the Political Action Committee and Political Action Fund are to be filed by the Treasurer of the Political Action Committee), and he shall cause to be maintained by the Association such records as the law may require to be kept in support of reports filed by the Association.
In addition to the foregoing, the Secretary-Treasurer shall exercise authority and perform such other duties as may be additionally prescribed in this Constitution and By-Laws or which may be delegated or assigned to him by the President, Executive Board, and Board of Trustees or the Convention Delegates.
SECTION 4a - DUTIES OF THE VICE PRESIDENTS
Vice Presidents shall serve as representatives of the Associated Fire Fighters of Illinois in
their respective districts and are empowered and charged with the responsibility to advise Local Unions in such districts, regarding Associated Fire Fighters of Illinois? policy and procedure. They shall make available their professional and technical skill and experience to such Local Unions when so directed by the Association President and shall contact Locals in their respective District urging them to participate in letter writing or phone campaigns on pending legislation as directed by the Legislative Committee.
The Vice Presidents shall attend all Conventions of the Association and meetings of the Executive Board, and the District Vice Presidents shall hold at least two (2) meetings of their District per year. By virtue of their election as Vice Presidents, they shall be Delegates-At-Large to all Conventions of this Association, entitled to a voice and vote, and full participation in the Convention proceedings. They shall submit to each Convention a report of all their official acts during the interim between Conventions. The Vice President-At-Large shall preside at such Conventions and Board meetings when called upon to do so by the President, or in the absence of the President, by the Executive Board. In the absence of the Vice President-At-Large, the Executive Board shall elect one of the Vice Presidents to serve as Chairman Pro Tem. The Vice President-At-Large shall also be the Educational Officer of the Association. He shall be responsible for all seminars pertaining to educating members and shall be responsible for disseminating all educational literature to the membership under the direction of the Executive Board. Additionally, the Vice President-At-Large shall share, with the District Vice Presidents, the responsibility to provide service.
The Vice Presidents shall furnish on forms provided by the Association Secretary-Treasurer itemized accounts of their expenses while in the actual performance of their duties.
In addition to the foregoing, each Vice President shall exercise authority and perform such other duties as are additionally prescribed in this Constitution and By-Laws, or which may be delegated or assigned to him by the Executive Board or by action of the Convention.
SECTION 4b - VICE PRESIDENT ASSISTANTS
Assistants to the Vice President will work with their respective Vice President to resolve problems in the district or be available when the District Vice President is not. The assistants will work under the direction of the District Vice President, so long as the work will be authorized and assigned by the President of the AFFI. Each district (1,2,3,4 and 5) may have up to two assistants to the Vice President. All members interested shall submit applications to the President for appointment as an assistant to the Vice President. The anticipated use of such assistants shall be 36 days for the entire State. The assistants shall be paid the meeting allowance rate as established in these By-Laws, while conducting AFFI business.
SECTION 5 - DUTIES OF THE LEGISLATIVE COMMITTEE
This Committee shall be composed of four (4) members, one from each established district (Northern, Central and Southern) elected by the Delegates at Convention, and the other Member being the President. They shall elect their own Chairman and Secretary after each Convention and the District Legislative Committee Members shall serve as directed by the Legislative Committee Chairman. They shall have full and complete charge of all legislative matters and activities concerning legislation of this Association, subject to performing the mandates of Convention action.
If a majority of the Legislative Committee cannot come to an agreement on what course of action to pursue on Association positions, on vetoes, overrides and final passage of legislation, such positions shall be subject to approval by the Executive Board. The Legislative Committee Members are mandated and shall support the majority position of the Executive Board. Any actions concerning amendments, committee positions and strategy on legislation shall require a majority vote of the Legislative Committee.
The Legislative Committee shall serve as the Political Action Committee of the Association. They shall have sole charge of the monies in the Political Action Fund to disburse as in their sound discretion they believe will best benefit the members of this Association, but shall take into consideration recommendations of affiliated members on disbursements in their districts. They shall keep accurate records of all financial transactions and shall submit all records to an audit by the Trustees or any certified accountant the Trustees shall so desire. They also shall be responsible for filing all necessary records the State and Federal Government may require.
The Secretary of the Legislative Committee shall report to the Secretary-Treasurer of the Association immediately on pending legislation and shall submit quarterly in writing a report of all work covered by the Legislative Committee. The Secretary of the Legislative Committee is required to submit a written report to the Delegates at each Convention on the progress of legislation from resolutions submitted at the previous Convention. Resolutions not acted upon or completed will be carried over for the next convention only. In addition to the foregoing, they shall exercise authority and perform such other duties as are additionally prescribed in this Constitution and By-Laws, or which may be delegated or assigned to them by the Executive Board or by action of the Convention.
SECTION 5a - UNAUTHORIZED INTRODUCTION OF LEGISLATION
No affiliated Local of this Association shall introduce or cause to be introduced any state
legislation affecting the Fire Fighters without the knowledge and consent of the Legislative Committee. This Section shall not apply to any legislation introduced by and affecting solely and only cities of over 500,000 population.
SECTION 5b - POLITICAL EDUCATION COMMITTEE
The AFFI President shall appoint up to 21 members to the Political Education Committee as District Committeemen throughout the State to better assist the Legislative Committee and serve our membership through political action. The Legislative Representatives and President shall serve on the Political Education Committee. The Committee?s goal is to meet three (3) times biennially to conduct its business.
The Committee?s purpose shall be to meet the need for sound political education and action among the Members of the AFFI. It shall encourage Members and their families to register and vote, to exercise their full rights and responsibilities of citizenship and to perform their rightful part in the politics of the State of Illinois. The Committee shall be responsible for planning, initiating, stimulating and assisting campaigns for state office only. The Committee shall be advisory only in its positions on endorsements of candidates and in no way shall its authority supersede the provisions of Article VII, Section 5.
SECTION 5c - LOCAL POLITICAL ACTION COMMITTEE
The AFFI Executive Board encourages each Local Union to appoint or elect a Political Action Committee and notify the AFFI of the Committee Chairperson?s name, address and phone number. A roster of Political Action Chairpersons will be kept at the AFFI office and utilized by the AFFI Legislative Committee and the AFFI Political Education Committee.
SECTION 5d - LEGISLATIVE CONFERENCE
The AFFI Legislative Conference shall be named, the ?AFFI Fran Gambro Legislative Conference? in honor and tribute to Fran and all the other ?regular? AFFI members who have unselfishly dedicated a significant part of their lives to the firefighters? union cause.
SECTION 6 - DUTIES OF THE TRUSTEES
The Board of Trustees shall be composed of three (3) members, one to be elected from each district (Northern, Central and Southern). The Board of Trustees shall audit the books of the Association each January and whenever there is a change in the officeholder of the Secretary-Treasurer of the Association or a change in the officeholder of the Treasurer of the Legislative Committee. In January of each year, the Trustees shall meet and formulate a preliminary budget for Executive Board consideration, adjustment and adoption. The budget shall be a departmental budget based on the previous year?s income and expenses. The Trustees may also check the books at such other times as they deem advisable. They shall engage an independent certified public accountant to make an audit of all accounts of the Association and any related funds or operations under control of the Association once each year, and they shall have full access to all books and records of these funds, operations and organizations pertaining to financial matters of these operations. The Board of Trustees shall also check the records and accounts of the Political Action Committee and audit or cause an audit to be made of this Committee annually. The Board of Trustees shall make a report of their findings on examination of the books and records of the Association funds and operations under the control of the Association to the Executive Board and to the Delegates at each Convention. After the report is accepted by the Executive Board, it shall be mailed to all affiliated Locals annually, and in Convention years at least thirty (30) days prior to Convention.
SECTION 7 - DUTIES OF THE EXECUTIVE BOARD
The Executive Board shall supervise all of the organization?s business not otherwise
provided for. Six (6) members shall constitute a quorum. The Executive Board shall hold quarterly meetings in such locations as the President may decide, and summary of reports of these meetings shall be sent to each affiliated Local. Additionally, the Executive Board shall meet at the call of the President or quorum.
The attorney or attorneys for the State Association shall be hired on a yearly retainer fee basis if deemed necessary by the Executive Board not to exceed (2) years in duration.
SECTION 8 - SALARY AND EXPENSE ALLOWANCE
a) Pending Biennial Convention confirmation the AFFI President, Secretary-Treasurer, Vice-Presidents? and Legislative Representatives shall receive a monthly salary increase equal to the average base wage increase experienced by member locals as calculated by the AFFI Database Manager.
For the purposes of calculating the monthly base wage increase, the AFFI Database Manager shall use all wage increases received on file effective December 31st of the preceding year. This increase shall not exceed 4% in any given year. Per capita shall increase annually on July 1st of each year by an amount equivalent to the increase.
Using this method, effective July 1, 2008, the salaries shall be:

b) The Trustees and Assistants to the Vice Presidents shall be paid a daily meeting allowance of $165.00 for each day they are required to conduct the business of the Association.
c) All Officers of the Association shall be allowed a travel allowance which shall be either: 1)a mileage allowance equal to the rate currently allowed by the Internal Revenue Service for travel within the State of Illinois; 2) air fare for travel outside of the State of Illinois; 3) reimbursement for air fare at cost for travel within the State of Illinois.
d) All Officers shall be reimbursed for the actual cost of lodgings incurred in the performance of their duties in carrying on the business of this Association.
e) Any other expenses incurred by Officers of this Association in the performance of their duties shall be reimbursed as authorized, receipted and approved by the Executive Board.
f) All Officers shall not be allowed any other compensation under any other Article or Section of this Constitution and By-Laws.
Officers and members of those standing Committees established by Convention action who must perform Association business on their scheduled duty day may vouch for duty day relief. Duty day pay shall be paid at the base hourly rate, excluding additional incentives and longevity of the Member performing the duty relief effective May 1, 1994. The AFFI will not pay a rate higher than the base hourly rate of the Officer being relieved. Duty day pay shall be used to reimburse an Officer who pays someone to work for them on their scheduled duty day when they must be away from duty to perform their duties as an Officer of this Association.
ARTICLE VIII
INITIATIVE REFERENDUM
SECTION 1 - INITIATIVE REFERENDUM
Initiative referendum may be had by petition of twenty percent (20%) of AFFI Locals.
The AFFI President shall, within fifteen (15) days of receipt of a referendum request, poll the Executive Board to choose a conveniently located meeting room where the Locals can gather and debate the issues. The caucus date shall be set to take place within forty-five (45) days of the original request. The President shall also appoint an Election Committee made up of one person from each District (1,2,3,4 and 5).
The AFFI Secretary/Treasurer shall send announcements of the caucus date and time along with specially printed envelopes and ballots to each Local. The ballots must be validated with the Locals? seal and returned to the Secretary/Treasurer no later than thirty (30) days after the caucus. Voting will be done by delegate strength as described in Article IV, Sections 2 and 3 of the AFFI Constitution & By-Laws. Sealed envelopes will be turned over to the Election Committee within fifteen (15) days after the deadline for return of the ballots to the Secretary/Treasurer.
The Election Committee shall meet to count the ballots on the day the Secretary/Treasurer turns them over. The Election Committee Members will be allowed one (1) day?s meeting allowance and travel expenses. Each District Vice President may choose two (2) observers to be present during counting. The Committee shall certify the ballot results to the Secretary/Treasurer at the conclusion of counting.
ARTICLE IX
AMENDMENTS
SECTION 1 - CONSTITUTION & BY-LAW AMENDMENTS
The AFFI Constitution & By-Laws shall only be amended by a two-thirds (2/3rds) vote of Delegates voting at any State Convention, or by a two-thirds (2/3rds) vote of the Delegate ballots cast as outlined in Article IV, Section 2, in a initiative referendum as set forth in Article VIII, except for those Articles and Sections listed in Section 2 of this Article.
SECTION 2 - AMENDMENTS REQUIRING ONLY A MAJORITY VOTE
The following areas of the Constitution and By-Laws will require only a majority vote to amend at any State Convention, or by a majority vote of the Delegate ballots cast as outlined in Article IV, Section 2, in a initiative referendum as set forth in Article VIII: Article IV, Section 10 - Registration Fee; Article V, Section 2 - Per Capita Tax; Article VII, Section 8 - Salary and Expense Allowance.
ARTICLE X
MATTERS NOT PROVIDED FOR
SECTION 1 - IAFF RATIFICATION OF AMENDMENTS
Any Amendments of the Constitution voted by referendum or Convention shall be effective immediately upon ratification by the International Association of Fire Fighters.
SECTION 2 - MATTERS NOT PROVIDED FOR
In matters not provided for, the Constitution of the International Association of Fire
Fighters shall apply.
SECTION 3 - RULES FOR MEETINGS
Atwood?s Rules for Meetings shall prevail if needed.
